Elder Law

Elder Law

  • Fletcher Tilton attorneys counsel clients and their families through stressful life transitions, create plans anticipating future transitions and protect client assets in the process.
  • We successfully represent many clients in complex and emergency appeals before the MassHealth agency and provide comprehensive advice to clients seeking information on long-term care plans and preretirement planning.
  • Our commitment to legal issues faced by elders is clear – one member of our practice group founded and remains director of the Central Massachusetts Partnership to Improve Care at the End of Life, another is an advisory board member for a nursing home.

Care and Concern

The Elder Law group of attorneys provides comprehensive legal services to older persons and their families in a caring and concerned environment. Using an interdisciplinary approach, our attorneys draw upon their experience in the areas of estate and retirement planning, Medicaid and Medicare eligibility, long term care issues and financing to provide our clients with protection and peace of mind.

We help our clients to maintain their homes through trust and estate planning. When needed, we secure nursing and personal care. We advise on trends in long-term care planning, and when desired, provide strategic counsel on the difficult decisions involved in placing family members into an assisted-living setting or a continuing-care retirement community.

The Group provides clients with advice and advocacy on Medicaid and Medicare eligibility and benefits, including representation at hearings and appeals.

Incapacity Planning

Our attorneys provide practical advice on the need to plan for incapacity. We discuss the costs associated with the appointment of guardians and conservators, as well as how to avoid such appointments by executing a Durable Power of Attorney. We also give consideration to the quality of life issues addressed by a health care proxy.
